Terms of service
Last updated October 28, 2026
These terms are the agreement between your organization and Pay AI, Inc., a Delaware corporation ("Potluck", "we", "us"), for using Potluck. They are short on purpose. By creating an account or using Potluck on behalf of an organization, you agree to them and you confirm that you are allowed to agree on the organization's behalf.
If you are a person giving through a Potluck giving page, the Giving policy is written for you, and sections 6, 9 and 10 of these terms apply to you as well.
1. What Potluck is
Potluck is software that lets an organization receive gifts online, record gifts received by cash and check, send receipts, and produce year-end statements. Payments are processed by Stripe under the organization's own Stripe account. Potluck is not a bank, does not hold funds, and is not a party to the gift between a giver and an organization.
2. Your account
You must give accurate information about your organization and keep it current. You are responsible for the people you invite and for what they do with the roles you give them. Keep your sign-in email secure; anyone who can read it can sign in as you. Tell us right away at hello@potluckpayments.com if you believe your account has been used without permission.
3. Stripe
To receive online gifts you must open a Stripe account through Potluck and accept the Stripe Connected Account Agreement, including the Stripe Terms of Service. Stripe may ask you for identity and bank details, may hold or delay deposits while it verifies them, and may close an account under its own rules. We do not control those decisions. Fees charged by Stripe are between you and Stripe.
4. Fees
The free plan has no monthly fee. Each online gift carries a platform fee of 0.75% of the gift amount, collected by Stripe from the gift before it is deposited, plus Stripe's processing fee. People who give may choose to cover these fees; when they do, the amount they add is a gift to your organization and is shown on their receipt. Recording cash and checks is free.
The paid plan is $39 a month, billed to a card you provide, in advance, for each month you remain on it. You can drop back to the free plan at any time; the change takes effect at the end of the month you have paid for, and nothing is deleted. We will give you at least 30 days' notice by email before changing any price.
5. Your responsibilities
You are responsible for the accuracy of the gift records, receipts and statements your organization produces with Potluck, including the deductible and non-deductible amounts you enter for events and purchases, and for complying with the tax rules that apply to you. Potluck produces receipts and statements from the records you keep; it does not give tax advice.
You agree to use Potluck only to receive gifts and payments for your own organization, not to process payments for others, and not for anything unlawful, deceptive or harmful. You will not use Potluck to send unsolicited email, to collect information about people beyond what the service collects, or to attempt to access another organization's records.
6. People who give
A person who gives through a Potluck giving page gives to your organization, not to Potluck. You decide whether a gift is deductible, and you are responsible for the information on the receipt. Refunds are at your discretion and are issued by you from the application; Stripe keeps its processing fee on a refund.
7. Your data
Your records belong to you. You can export them at any time. We use them only to provide the service, as described in the Privacy policy, and we never sell them. If you close your account, we delete your organization's data within 30 days of your request, after one last export, except for records we must keep by law.
8. Our responsibilities
We will provide Potluck with reasonable skill and care and keep it available except for maintenance and matters outside our control. We will tell organizations by email at least 30 days before we discontinue a feature on the free plan that they are using, and at least 90 days before we discontinue Potluck, with time to export.
9. What we are not responsible for
Potluck is provided as it is. To the fullest extent the law allows, we make no warranties, express or implied, including about fitness for a particular purpose, and we are not liable for indirect, incidental, special or consequential damages, lost gifts, or lost data, even if we were told they were possible. Our total liability to you for any claim arising from these terms or from Potluck is limited to the platform fees and subscription fees you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Disputes
These terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Before either of us brings a claim, we agree to write to the other and try for 30 days to resolve it. Any claim that cannot be resolved will be brought in the state or federal courts located in Minnesota, and each of us consents to their jurisdiction.
11. Changes to these terms
We may update these terms. If a change matters, we will email organizations at least 30 days before it takes effect. Continuing to use Potluck after that date means you accept the change. If you do not, you may close your account and export your data before the change takes effect.
12. Ending the agreement
You may stop using Potluck at any time. We may suspend or close an account that breaks these terms, that Stripe has closed, or that is being used in a way that harms people who give or other organizations, and we will tell you why unless the law prevents it. Sections 5, 6, 7, 9 and 10 survive the end of this agreement.
